New Jersey's top prosecutor steps down after appeals court deems ineligible her.

The ex-lawyer for the former president has stepped down as the US Attorney for New Jersey. This comes after a court battle that invalidated her legal standing to serve.

Attorney General's Statement

The nation's top law enforcement official, Pam Bondi, confirmed Habba's resignation on Monday. In a statement that the appeals court finding made it impossible for Habba to perform her duties.

"Let no one confuse following the order as giving up," Habba stated. "The effort will now reach across the nation."

Legal Background

The departure was triggered by a federal appellate panel found that she had been unlawfully serving as US attorney. This judgment is likely to affect scores of criminal cases in the state.

The court said that a temporary posting that bypassed the advice and consent of the Senate violated the federal law governing appointments.

Future Role and Reaction

Bondi said that the former prosecutor will continue working within the justice department as a senior adviser. Habba plans to seek further review of the ruling, in the hope of achieving a reversal.

In a statement, the Attorney General wrote that judges "must not override the President's choice of prosecutors entrusted with performing the fundamental role of the presidency of enforcing the law."

The attorney general highlighted her tenure and said that while she was in charge, the city of Newark saw a significant drop in offenses. Additionally that the city of Camden experienced its initial homicide-free summer since 1974 with no murders.

Legal Career

Habba, 41, originally became part of Donald Trump's lawyers in 2021. Subsequently, she represented her client in his hush-money trial in the previous year, when he was conviction on multiple felony counts of financial record manipulation.

Earlier, assuming the top New Jersey post, the former president had stated he was selecting her as his senior adviser if re-elected, labeling Habba as deeply loyal and a "tireless advocate for justice".
